Cumberland County, NC: Soldier seeks pro bono assistance to vacate default divorce judgment after possible SCRA violation

An Army servicemember seeks pro bono assistance with a divorce matter that may involve a violation of the Servicemembers Civil Relief Act (SCRA). The soldier’s wife filed for divorce and sent service to an address where the sailor did not live shortly before his deployment to the middle east.  While he was deployed, he received the default judgment and became aware of the divorce for the first time. His spouse falsified the petition for divorce and there were no provisions in the judgment as to parenting of the couple’s child. Based on the divorce, the soldier is now being investigated for fraud for benefits he received from the military while he believed they were still married. He seeks pro bono assistance to vacate the default judgment so that he can participate in the divorce proceedings.
